Flavoured milk vs proprietary dairy drink: keep pack and e-comm category consistent

When a dairy drink leaves the plant, three surfaces have to agree: the front of pack, the back of pack, and the online listing. In October 2026, FSSAI's public enforcement posts made that point again on ready-to-drink dairy coffee beverages — without this page naming any company. The lesson for flavoured milk, fruit-milk and café RTD makers is category discipline, not a flavour story.

🧾 What the regulator flagged

Business Standard and The Tribune reported notices where the front said Flavoured Milk, the back said Proprietary Food — dairy-based drink, and e-commerce copy used still other phrases. FSSAI's position, as reported, was that those SKUs sat under the standardised Flavoured Milk category in the Food Products Standards, so a proprietary declaration was the wrong box.

That is a consistency failure as much as a wording failure. The Advertising and Claims Regulations, 2018, and the Labelling and Display Regulations, 2020, both catch pack and advertising that mislead about the nature of the food.

🍓 Where fruit preparations fit

Fruit pulp or puree in a milk drink changes Brix, colour and aroma. It does not create a free pass to mix category names. Brief the fruit preparation (percentage, soluble solids, acidity) on the same sheet as the legal category your advisor signs. See How to read a fruit preparation spec and Labelling fruit preparations.

✅ Maker checklist (concept only)

  1. Confirm whether the formula is standardised Flavoured Milk or a true proprietary dairy drink.
  2. Lock one category phrase for front, back and marketplace title.
  3. Align "crafted with…" marketing lines with the declared composition.
  4. If sugars are natural, plan the CONTAINS NATURALLY OCCURRING SUGARS line early — see Reconstituted fruit and no-added-sugar labelling.
  5. Archive a PDF of the live listing the day you go live.

Questions

What went wrong in the 2026 notices?

Public reporting described ready-to-drink dairy coffee beverages whose front pack said Flavoured Milk while the back declared Proprietary Food — dairy-based drink, with online listings using coffee-flavoured-milk style wording. FSSAI treated the products as falling under standardised Flavoured Milk, so the proprietary declaration was incorrect. We do not name the companies here.

Does adding fruit puree change the category?

Fruit solids change the sensory brief and may change which standard or proprietary route applies, but they do not let you print one category on the front and another on the back. Your regulatory advisor maps the formula to the Food Products Standards chapters before you lock artwork.

What should R&D and marketing align on?

The legal category name, the principal display panel wording, the ingredients list, any natural-sugars line, and the exact e-commerce title and bullets. Screenshot the live listing after upload.

Is this legal advice?

No. It is a plain-language reading of public enforcement reporting and the Advertising and Claims / Labelling and Display frameworks. Your advisor applies them to your SKU.
